Terms of Service

These Terms of Service ("Terms") govern your use of the websites, applications and services operated by Spark Dev Community ("Spark Dev", "we", "us") — including Spak (music streaming), Spak Creators, Spirit (search), SUN_SET and Spaki VPN (collectively, the "Services"). By accessing or using the Services you agree to these Terms.

1. Who can use the Services

You must be at least 13 years old (or the age of digital consent in your country, if higher) to create an account. If you are under 18 you confirm you have permission from a parent or legal guardian.

2. Accounts

• You are responsible for activity under your account and for keeping your credentials secure.
• Provide accurate information when you register. We may require email verification before full access.
• One person per account. You may not share, sell or transfer your account.

3. Your content

If you upload tracks, artwork, lyrics, playlists, comments or any other content ("User Content") through Spak Creators or other parts of the Services, you:

• Confirm you own the rights or have the necessary licences (including performing-rights, mechanical and publishing rights).
• Grant Spark Dev a worldwide, non-exclusive, royalty-free licence to host, cache, stream, reproduce, reformat and display that User Content solely to operate the Services.
• Remain the owner of your User Content. You can remove it at any time (except where it must be retained by law).

4. Acceptable use

You agree not to:

• Infringe anyone's copyright, trademark, privacy or other rights.
• Upload malware, run denial-of-service attacks, scrape at abusive rates, or circumvent rate limits and security controls.
• Use the Services to distribute unlawful, hateful, harassing, sexually explicit content involving minors, or content that glorifies self-harm or violence.
• Reverse-engineer, resell or relicence the Services except where local law gives you a non-waivable right to do so.

5. Third-party music sources

Spak streams audio through public APIs (JioSaavn, Audius, Piped/YouTube proxies) and from creator uploads. We do not own that catalogue. Availability can change at any time and we make no warranty that a particular track will remain playable.

6. Payments and creator payouts

Where the Services offer paid features (e.g. promotions, tips, subscriptions), payments are processed by Stripe or another listed provider. Their terms apply in addition to ours. Creator payouts are subject to our payout schedule, minimum thresholds and applicable tax withholding in your jurisdiction.

7. Availability, changes and termination

• The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access.
• We may add, change or remove features at any time. We will give reasonable notice for material changes.
• We may suspend or terminate your account if you breach these Terms, if required by law, or if your use creates risk to other users. You can close your account at any time from Settings.

8. Intellectual property

"Spark Dev", "Spak", "Spirit", "SUN_SET", "Spaki VPN", the logos and the product design are owned by Spark Dev. These Terms do not grant you any right to use our names or marks except to identify the Services.

9. Disclaimers

To the maximum extent permitted by law, Spark Dev disclaims all warranties — express, implied or statutory — including fitness for a particular purpose and non-infringement. You use the Services at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, Spark Dev shall not be liable for indirect, incidental, consequential or punitive damages, or for loss of profits, data or goodwill. Our total liability for direct damages is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) EUR 100.

11. Governing law

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules. Disputes will be resolved in the competent courts at the location of Spark Dev. Nothing in this clause limits consumer rights that you have under the law of your country of residence.

12. Changes to these Terms

We will post the updated Terms at sp-a-rk.online/terms with a new "Last updated" date. If changes are material we will notify you through the app or by email. Continued use after the effective date constitutes acceptance.
